This Privacy Policy explains how Nesteye, Inc. ("Nesteye," "we," "us," or "our") collects, uses, and discloses information when you visit nesteye.ai, contact us, participate in a pilot program, or use our Edge AI monitoring system and related software (collectively, the "Services").
We are a Delaware corporation headquartered in Austin, Texas. By using the Services, you agree to the practices described here.
2. Information We Collect
Information you provide
- Contact information. Name, email address, farm or company name, and the contents of any message you send through our contact form or by email.
- Account information. If we provision a dashboard account for you, we collect your name, email, phone number (for alerts), and barn or farm identifiers.
- Pilot and customer agreements. Signed agreements, billing details, and correspondence related to deployment of the Services.
Information collected automatically
- Device and log data. Browser type, operating system, referring URL, pages viewed, and approximate location derived from IP address when you visit the website.
- Edge device telemetry. Health metrics from deployed hardware (CPU, memory, model version, connectivity status) and operational metadata such as alert timestamps and inference counts.
Information from third parties
We may receive information from integrator partners (for example, broiler integrators that introduce us to their contract growers), business contact databases, and service providers such as email and analytics platforms.
3. How We Use Information
- To respond to inquiries and provide the Services.
- To deliver real-time alerts, dashboards, and reports to authorized farm users.
- To improve our machine learning models, hardware design, and Service reliability, using imagery and operational data in accordance with the Farm and Product Data section below.
- To send transactional communications (account, billing, security, and product updates).
- To comply with legal obligations, enforce our agreements, and protect the rights, safety, and property of Nesteye, our customers, and the public.
- With your consent, to send marketing communications. You may unsubscribe at any time.
5. Data Retention
We retain personal information for as long as needed to provide the Services and for legitimate business or legal purposes. Contact form submissions are retained for up to twenty-four (24) months unless you request earlier deletion. Operational telemetry and aggregated model data may be retained longer for product improvement, in a form that does not identify individual people.
6. Security
We use commercially reasonable technical and organizational measures to protect information, including encryption in transit, access controls, edge-first architecture that keeps real-time video on the device, and least-privilege cloud permissions. No system is perfectly secure, and we cannot guarantee absolute security of information transmitted to or from the Services.
7. Your Rights and Choices
Depending on where you live, you may have rights to:
- Access the personal information we hold about you.
- Correct inaccurate information.
- Request deletion of personal information.
- Opt out of marketing communications.
- Receive a portable copy of your information.
- Appeal a denial of a privacy request.
Residents of California (CCPA/CPRA), Colorado, Connecticut, Texas (TDPSA), Utah, and Virginia have additional rights under state law. We do not "sell" or "share" personal information for cross-context behavioral advertising as those terms are defined under the CCPA. To exercise any right, email team@nesteye.ai. We will verify your identity before acting on your request.
We do not discriminate against you for exercising any of these rights.
8. Farm and Product Data
When the Services are deployed on a farm, the Edge AI device captures video, environmental readings, and behavioral inferences within the barn. As between Nesteye and the farmer:
- The farmer owns the underlying barn imagery and sensor readings ("Farm Data").
- Nesteye owns its software, models, and the derived metadata and metrics generated by inference ("Derived Data"), and retains all intellectual property in its hardware, firmware, and software.
- Nesteye holds a license to use Farm Data to operate the Services, improve our models, and develop new features. Where feasible, we use de-identified or aggregated forms.
The specific terms governing Farm Data are set out in the farmer's pilot agreement or master services agreement and prevail over this Privacy Policy if there is any conflict.
10. Children's Privacy
The Services are intended for adult agricultural professionals. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact team@nesteye.ai and we will delete it.
11. International Users
Nesteye is based in the United States and processes information here. If you access the Services from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, which may have data protection laws different from those in your country.
12. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above. Material changes will be communicated by email or a notice on the Services.
